    Governor Ademola Adeleke dissolved the elected local chairmen and councillors, which happened to be APC (chairmen and councilors) when he assumed office in November 2022. APC took the matter to the State High Court, questioning the legality of the dissolution. State High Court ruled in favor of Governor Ademola Adeleke. Judgment delivered, the court upheld his decision to dissolve the elected local government chairmen and councilors, affirming the legality of his actions. The court ruled that Adeleke, as the newly elected governor, had the constitutional right to dissolve the local government structures put in place by his predecessor.
    APC took the case to the Appeal Court in Akure. While the case is in the Appeal Court, Governor Ademola Adeleke is organizing another local government election and he appointed Barrister Hasim Akintunde Abioye as chairman of Osun State INEC.
    The chairman of the Independent National Electoral Commission (INEC), whether at the state or federal level, is expected to be impartial and should not be associated with any political party.
    In the case of Barrister Hasim Akintunde Abioye, who was appointed as the chairman of the Osun State INEC, there have been concerns regarding his political affiliation. Hasim Abioye is a registered member of the People's Democratic Party (PDP) and had contested for a House of Assembly seat in 2019, which raises questions about his neutrality. This could be viewed as a potential conflict of interest, as individuals in such a role are typically expected to be free of any political party affiliation to maintain the integrity of the election process.
    Under the Nigerian Constitution and the Electoral Act, there are provisions ensuring the independence of INEC members. For example, INEC officials, including state electoral commission chairmen, should be appointed based on their competence, impartiality, and lack of political bias.
    APC has raised concerns and is seeking the disqualification of Barrister Hasim Akintunde Abioye from serving as the chairman of the Osun State INEC. This legal challenge stems from his political background, as he is a registered member of the People's Democratic Party (PDP) and had previously contested for a House of Assembly seat in 2019.
    The APC argues that his prior political affiliation and involvement with the PDP violate the expected neutrality of an INEC official, especially given the critical role of the INEC chairman in overseeing free and fair elections. According to the Electoral Act and Nigerian constitutional principles, individuals holding such positions should not have any affiliation with political parties to ensure impartiality in the conduct of elections.
    The APC's legal action in this regard aims to have Barrister Abioye disqualified from his position, asserting that his appointment compromises the integrity and fairness of the electoral process in Osun State. The case is already in the courts, where the judicial system will determine if his appointment stands or if he should be disqualified based on his political history.
    On February 15, 2025, the Court of Appeal indeed delivered its final ruling in favor of the All Progressives Congress (APC), nullifying Governor Ademola Adeleke's action of dissolving the elected local government chairmen and councilors. The court ruled that the governor's dissolution of the local government officials was unconstitutional, upholding the legality of the tenure of the affected officials. This ruling marked a significant development in the legal battle and reaffirmed the position of the APC in the dispute.

    In Edo State, democratically local government elected chairmen and counselors was displaced in Edo State and federal government did nothing about it.
    Oyetola and APC must call to order.
