Man, Mer, and Betmer have "sentient" souls or something, which cannot be contained in a typical soulgem. Black Soul Gems are tainted to bypass that–they're the same as greater soulgems otherwise, and can hold the same things, just can also hold human souls. It's nothing about murder, as you can simply rely on bandits to fill them.
