i guess, because he was alone in his room hided under the blanket, and the muggels was sleeping.
cause the ministry charm can only decect other charms in the area of a underager and if there are muggels around and awake or sleeping, but cant dedect who muggle is there, like the user of the charm.
cause normally harry wouldnt get punished in 5. part, when they had known the muggle was his cusin dudley who knows about the secret.
